CADET: Collecting and Admitting Digital Evidence at Trial

The IACIS CADET (Collecting and Admitting Digital Evidence at Trial) course is a 36-hour class designed for attorneys who deal with computer forensic evidence in criminal cases. After completing this course, attorneys will have a greater understanding of the digital forensic investigative process, including how to collaborate with investigative partners to obtain and preserve digital evidence, how to present this evidence to a lay audience and ensure its admissibility at trial, and how to anticipate and overcome common defenses to digital findings. The course will cover topics that arise throughout the lifespan of a criminal case, ranging from investigation to appeal.

This course is intended to introduce computer forensics and related legal issues. No previous knowledge of computer forensics or significant trial experience is expected.

Throughout the week, students will cover the following topics:

  • Digital investigations: types of evidence available; preserving digital evidence and collection methods; drafting effective search warrants for digital devices and data; orientation to the various tools available to a computer forensic investigator and the relevant industry certifications.
  • Digital forensic reports: working with a forensic examiner in real time to produce an accurate, relevant, and thorough examination report; navigating and understanding the various types of examination reports; preparing the report for discovery and disclosing digital findings.
  • Pre-trial considerations: common suppression issues; identifying and supplementing weaknesses in your evidence; special considerations in charging documents and plea agreements; anticipating and responding to common defenses
  • Digital evidence at trial: laying proper foundations for digital evidence and overcoming other hurdles to admissibility; making digital forensics accessible to the lay juror (and judge); introducing forensic concepts during voir dire and identifying potentially challenging jurors; selecting and preparing your forensic expert witness; challenging the opponent’s expert witness.
  • Sentencing and beyond: presenting digital forensic evidence at sentencing; sentencing guidelines issues involving computer crimes; appellate issues involving digital forensic evidence; emerging legal issues.

2025 CLE Accreditation: This page will be updated as we file for CLE approval. For 2025, IACIS anticipates applying for accreditation in the following states: AL, CA, FL, IL, NY, NC, OH, PA, SC, TN, TX, VA, WA. The following states do not require CLE: DC, MD, MA, MI, SD, and the following states have reciprocity with the states where CLE accreditation will be sought: AK, AR, AZ, CT, ME, ND, NJ, OR, WI. If there are a significant number of registrations from any of the states not listed above where accreditation is required, and reciprocity is not available, we anticipate submitting an application to those states. IACIS will be applying for CLE accreditation only and will not be filing credits for those who attend. All attendees will be responsible for filing their CLE certification and any other required documents directly with the applicable state bar or accreditation entity.

Cancellations within 45 days from the start of class to 31 days from the start of class will be subject to a $150 cancellation fee. There will be no refunds within 30 days from the start of class.****

COURSE NOTES:

Please read the following notes regarding this class:

  1. Classes begin at 8:00 AM ET and conclude at 5:00 PM ET each day, with a one-hour lunch break. Classes will end at 4:00 PM ET on the last day of class. Please do not arrange for departing flights prior to 7:00 PM ET to allow time for travel to the airport and any security clearances.
  2. The dress code for the conference is business casual (collared shirts and slacks). The wearing of shorts, flip-flops, tank tops, etc., is not allowed in the classroom. Personal computers are not permitted in the classroom. Students are required to attend all classes to successfully complete the program. Students who fail to meet the attendance requirements will not be issued a certificate at the conclusion of the program.

The course will be taught at the Caribe Royale Hotel, 8101 World Center Drive, Orlando, Florida 32821 (USA).  This hotel is 16 miles from the Orlando International Airport, it has a large pool, spacious workout facility and is close to Disney World and Universal Studios.

CANCELLATION INFO: If IACIS is unable to hold the Orlando training event, then all students who have registered and paid will have the option of a full refund or a reserved seat at next year’s training event. IACIS is not responsible for any outside expenses (e.g., travel and accommodation) in the event of the training event being canceled. Anyone who paid for training will receive complimentary membership through the year that his/her training takes place.
